TERMS AND CONDITIONS
1. Upon registering, the parent and child agree to abide by these, or any amended Terms and Conditions.
2. The Club Administrator may revise these Terms and Conditions from time to time without notice to Members and Member Parents. Since Members and Member Parents are bound by the most current version of these Terms and Conditions, a Member and Member Parent should periodically check the Terms and Conditions.
3. A Member’s continued membership to the Club following the posting of any changes to the Terms and Conditions constitutes acceptance of those changes.
4. Participation in the Club is only open to residents of Tasmania aged 2 – 12 years (inclusive). Applications for membership to the Club are only open to, and must only be submitted by, residents of Tasmania who are parents or legal guardians of a Member (Member Parents). Members who do not have or provide the required consent of their Member Parent (as and where required) will not be admitted to the Club. These Terms and Conditions will bind all Members and Member Parents.
4a. Membership and benefits are non-transferable. Parents/Guardians must accompany and remain with their children, and are responsible for their supervision at Kids Club events and activities.
4b. The cost of membership is $15.00 + gst per child per year.

HOW TO APPLY FOR MEMBERSHIP TO THE CLUB
To apply for membership a Member Parents must complete either Written Registration or Online Registration in the manner required, as follows:

To register in this way, Member Parents must:
Attend any event that Kids Party Solutions is attending
obtain an official membership application form from staff and fully and correctly complete the application form in the manner required, including providing the Member’s full names, dates of birth, residential address(es) or postal address(es), and Member Parent’s title, full names, current and valid email address(es), consent of the Member Parent and contact telephone number(s), mobile telephone number(s) (if applicable), (Application); and hand the completed Application along with payment to a Staff Member at the event or mail it to:

ONLINE REGISTRATION:
To register online, Member Parents must:

and click on the membership link ;
fully and correctly complete and successfully submit in the manner required the online membership application form, including providing the Member’s full names, dates of birth, residential address(es) or postal address(es), and Member Parent’s title, full names, current and valid email address(es), and consent of the Member Parent and contact telephone number(s), mobile telephone number(s) (if applicable).
6. The decision by the Club Administrator to accept or reject any Application is in the Club Administrator’s sole discretion and no correspondence will be entered into. Applications submitted via In-person must be original and photocopies or images of these Applications will not be accepted.
7. All Applications received will be considered final by the Club Administrator. Incomplete, inaccurate, erroneous, ineligible or incomprehensible Applications will be deemed invalid. The Club Administrator accepts no responsibility for late, lost or misdirected Applications.
8. The Club Administrator reserve the right to verify the validity of any and all Applications and reserve the right to disqualify any Member if the Member or Member Parent:
• tampers with the Application process;
• submits an Application which is not in accordance with these Terms and Conditions; or
(c) Engages in any unlawful or other improper misconduct calculated to jeopardize the fair and proper conduct of the Club. The Club Administrator’s legal rights to recover damages or other compensation from such an offender are reserved. Members will only be admitted to the Club following any Member, Member Parent or Application validation and verification that the Club Administrator requires in their sole discretion.
9. Costs associated with accessing the Club Website remain a Member Parent’s responsibility and may vary depending on the Internet service provider used. Contact details entered incorrectly on the Club Website by a Member Parent will deem an Application invalid and the Member will not be admitted to the Club.
10. Following receipt and acceptance of an Application, the Club Administrator will send by email to the Member (to the email address nominated in their Application) a letter welcoming the Member to the Club with there login details.
GENERAL
11. The Club Administrator’s decision in relation to all aspects of the Club is final and no correspondence will be entered into.
12. All rewards included in membership to the Club are subject to availability at any given business, and said business may apply there own terms & conditions.
13. The use of any automated software or any mechanical, electronic or other means that allows a Member or Member Parent to automatically apply for Club membership, obtain rewards is prohibited.
14. Any attempt to cause malicious damage or interference with the normal functioning of the Club Website or the information on the Club Website, or to otherwise undermine the legitimate operation of the Club may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Club Administrator reserves the right to seek damages to the fullest extent permitted by law. If the Club Administrator suffers loss or incurs any costs in connection with any breach of these Terms and Conditions or any other legal obligation by a Member and/or Member Parent, the Member and/or Member Parent agrees to indemnify the Club Administrator for those losses, damages and costs.
15. The Club Administrator reserves the right to suspend or terminate the Club at any time without prior written notice to Members and Member Parents. The Club Administrator will not be liable for the suspension or termination of the Club on any account whatsoever including (without limitation) for any Club membership benefits accrued or unredeemed by a Member at the time of suspension or termination and no refund will be issued.
16. The Club Administrator will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Club, if the deficiency is occasioned by any cause outside the reasonable control of the Club Administrator.
17. If for any reason the Club is not capable of running as planned, including but not limited to war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or anything which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Club, the Club Administrator reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Club.
18. The Club Administrator and their, associated agencies and companies exclude all liability (including negligence) except for any liability that cannot be excluded by law, for any direct or indirect injury, loss and/or damage arising in any way out of the Club. This includes, but is not limited to: (i) technical malfunctions, delays or failures, including those resulting from accessing any materials related to the Club (including via the Club Website) and any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, the Club as a result of any technical malfunctions, delays or failures; (ii) theft, unauthorized access or third party interference; (iii) lost or damaged Applications, reward claims or rewards; and/or (iv) acceptance and/or use of any reward. Any tax, liability or duty arising from membership to the Club is the responsibility of each Member Parent.
19. The Club Administrator collects personal information about a Member and Member Parent to award membership to the Club and, where appropriate, rewards. If the personal information requested is not provided by a Member Parent, the Member may not be able to participate in the Club. By submitting an Application for membership to the Club, a Member and Member Parent also acknowledge that a further primary purpose for collection of the Member’s and Member Parent’s personal information by the Club Administrator is to enable the Club Administrator to use the information to assist the Club Administrator in improving goods and services, to contact the Member and Member Parent in the future with information on special offers, and to provide the Member and Member Parent with marketing materials via any medium including mail, telephone and commercial electronic messages (SMS (Short Message Service), MMS (Multimedia Message Service), IM (Instant Messaging) and email) or any other form of electronic, emerging, digital or conventional communications channel whether existing now or in the future. By submitting an Application for membership to the Club, a Member Parent acknowledges and agrees that the Club Administrator may use the Member’s and Member Parent’s personal information in the manner set out in this condition.
20. A Member and Member Parent may gain access to, update or correct any personal information held by the Club Administrator by contacting the Club Administrator’s at: P O Box 2017 Newnham 7248 or via emailing the administrator at kidsclub@kidspartysolutions.com.au . All personal information will be stored at the office of the Club Administrator. A copy of the Club Administrator’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Club Administrator.
